Terms of use

1. Purpose

These terms of use govern access to and use of the seating plan and guest management tool (the “Tool”) provided by MoonRay Weddings (the “Publisher”) on plan.moonraycreations.com. Wedding planning services (consultations, planning, coordination) are covered by separate terms.

2. Acceptance

By creating an account, you accept these terms in full. If you do not accept them, you must not use the Tool.

3. Description of the service

The Tool lets you draw a floor plan, manage a guest list, seat your guests and export various documents. It is provided free of charge. The Publisher may change, update or discontinue all or part of its features, and may later offer paid options, which will be clearly indicated.

4. User account

• You agree to provide accurate information and keep it up to date.
• You are responsible for keeping your login details confidential and for all activity on your account.
• Each account can manage up to 5 events.
• People you invite to collaborate on your plan must create their own account.

5. MoonRay Weddings’ access to your plan

Astrid (MoonRay Weddings) automatically has view access to every plan created with the Tool and may leave comments on it. This access cannot be removed. She can only edit your plan if you invite her to.

6. Data you enter

You remain responsible for the information you enter in the Tool, including your guests’ data (names, emails, phone numbers, diets or allergies). You agree to enter only the data you need, to inform your guests and, where required, to obtain their consent. See our privacy policy.

7. Free service, provided “as is”

As the Tool is provided free of charge, it is offered “as is” and “as available”. The Publisher does not guarantee that the Tool will be error-free, uninterrupted or fit for any particular purpose. It is your responsibility to check the documents produced (plans, lists, place cards) before using or printing them.

8. Liability and loss of data

To the extent permitted by applicable law, the Publisher cannot be held liable for:

• any loss, corruption or deletion of data, whatever the cause;
• any interruption, unavailability or malfunction of the Tool;
• any indirect damage arising from the use of, or inability to use, the Tool;
• any error in exported or printed documents.

Nothing in these terms excludes or limits any liability that cannot be excluded or limited by law, in particular in the event of gross negligence or wilful misconduct.

9. Backing up your data

You are solely responsible for backing up your data. We strongly recommend that you regularly download your floor plan and guest list using the exports available in the Tool, especially before your event.

10. Retention and deletion

An event’s data is deleted 6 months after the event date. Email reminders are sent 60, 30 and 7 days before deletion so that you can download your data. You can delete your account and your data at any time.

11. Acceptable use

You agree not to use the Tool for unlawful purposes, not to attempt to disrupt it or access other users’ data, and not to publish unlawful content in it.

12. Suspension and termination

The Publisher may suspend or delete an account that does not comply with these terms. You may stop using the Tool and delete your account at any time.

13. Intellectual property

The Tool, its code, its design and the MoonRay Weddings brand belong to the Publisher. You keep the rights to the content you upload (for example your venue’s floor plan) and allow the Publisher to host and display it in order to run the Tool.

14. Changes to these terms

The Publisher may change these terms. If the changes are significant, you will be informed by email or in the Tool. Continuing to use the Tool means you accept the new terms.

15. Governing law and disputes

These terms are governed by French law. In the event of a dispute, you can contact us to seek an amicable solution. If you are a consumer, you may also use a consumer mediator free of charge: [Mediator’s name and contact details — TO BE COMPLETED].
